Terms and Conditions

These Terms of Service (“Terms”) form a binding agreement between you (“you,” “your,” or “User”) and MemberGig, LLC (“MemberGig,” “we,” “us,” or “our”). By accessing or using the MemberGig website, mobile site, or any services we provide (collectively, the “Platform”), you agree to be bound by these Terms.

User” refers to anyone who accesses or uses the Platform in any capacity, including Board Owners, Sellers, Visitors, and any other individuals browsing or interacting with MemberGig.

Platform” or “Services” refers to all websites, applications, features, tools, and digital services controlled by MemberGig that allow Users to create boards, post content, interact with others, and participate in community or marketplace activities.

 

1. Introduction

 

1.1 Welcome to MemberGig
MemberGig is a community-driven marketplace where users can create boards, post content, and interact with others. By using MemberGig, you agree to follow these Terms of Service and any other rules or guidelines that apply to specific features or services.

 

1.2 How MemberGig Works

  • Board Owners: Create and manage boards. Boards can be monetized (earn revenue from posts) or non-monetized (allow posts for free).
  • Sellers: Subscribe to a Board Owner’s board to post goods, services, or other content (“Content”). Sellers become members of the specific boards they post on.
  • Visitors: Browse public boards, view posts, and interact with Sellers and Board Owners after creating a platform account.

 

1.3 Acceptance of These Terms
By accessing or using MemberGig, you confirm that you have read, understand, and agree to be bound by these Terms, along with any applicable policies or guidelines referenced herein. These Terms form a binding legal agreement between you and MemberGig. If you do not agree to any part of these Terms, you must stop using the platform. MemberGig may enforce these Terms as necessary.

 

1.4 Eligibility
You must be 18 years or older to use MemberGig. If you are using the platform on behalf of a business or organization, you must have the authority to agree to these Terms for that entity.

 

1.5 Platform Services
MemberGig provides tools to:

  • Create and manage boards.
  • Post content and interact with other users.
  • Connect Sellers with Visitors and Board Owners.

 

2. User Registration

 

2.1 Creating an Account
To use MemberGig, you must create an account with accurate and current information. This includes your username, password, email, and any role-specific details (e.g., Board Owner, Team Member, Seller, or Visitor). You agree to keep this information up-to-date.

 

2.2 User Roles
Your account role determines what you can do on MemberGig:

  • Board Owner: Creates and manages boards (monetized or non-monetized) and manages posts, Sellers, and Visitors on their boards.
  • Team Member: Assists a Board Owner with board management but cannot create boards under their account or access the Board Owner’s confidential information, including any financial details and earnings.
  • Seller: Posts content such as goods or services on Board Owners’ boards and communicates directly with Visitors.
  • Visitor: Can view public boards and browse content. Must create an account to contact Sellers and may become a Seller by subscribing to post.

 

2.3 Account Security
You are responsible for keeping your login credentials and account information secure. Notify MemberGig immediately if you suspect unauthorized access. MemberGig assumes no liability for any losses arising from your failure to safeguard your account.

 

2.4 User Responsibilities
When using MemberGig, you agree to:

  • Provide truthful and up-to-date account information.
  • Keep your login credentials confidential.
  • Follow all applicable laws and regulations.
  • Use the platform respectfully and in line with MemberGig’s community guidelines.

 

2.5 Prohibited Uses
You may not:

  • Misrepresent your identity or create accounts under false pretenses.
  • Share your sensitive account or login information.
  • Use MemberGig for illegal, fraudulent, or harmful activity.
  • Post content that violates others’ intellectual property rights.
  • Post private, confidential, or sensitive information about others.
  • Harass, spam, or disrupt the community.

 

2.6 Account Termination & Suspension
MemberGig may suspend or terminate your account for violating these Terms. You may also close your account at any time. Account termination revokes access, but obligations incurred before termination remain in effect.

 

2.7 Keeping Your Account Updated
You agree to keep your account information accurate and current, including email, login credentials, and any personal or business details. MemberGig is not responsible for issues caused by outdated or incorrect account information.

 

2.8 Age Requirement
You must be at least 18 years old to create an account. By registering, you confirm you meet this requirement. Users under 18 are not permitted to use MemberGig.

 

3. Board Owner Responsibilities

 

3.1 Board Creation & Management
Board Owners are responsible for creating and managing their boards. You must ensure your boards comply with all applicable laws and with MemberGig’s policies, guidelines, and procedures, including those related to pricing, board cancellation, refunds, and content rules.

 

3.2 Content Management & Oversight
Board Owners are responsible for managing the content that appears on their boards in accordance with MemberGig’s Community Guidelines. Board Owners do not create or modify these guidelines but may monitor posts and take action when issues arise, such as removing posts or restricting Seller access where permitted. MemberGig does not pre-screen or approve board content and reserves the right to remove Content or suspend boards if violations of these Terms, the Community Guidelines, or applicable laws occur.

 

3.3 Payments & Transactions
Payments from Sellers on monetized boards are processed through Stripe. Board Owners must connect a valid Stripe account to receive funds. All applicable transaction fees, including MemberGig’s platform fee (15% on monetized boards) and Stripe’s processing fees, are automatically deducted. You are responsible for maintaining your Stripe account and ensuring accurate payment information to receive payouts.

MemberGig is not a party to transactions between Board Owners and Sellers and does not act as the seller, buyer, broker, or merchant of record. Board Owners are solely responsible for managing all refunds, cancellations, disputes, and chargebacks with Sellers through their connected Stripe account. MemberGig does not issue refunds or resolve payment disputes on your behalf.

Board Owners using non-monetized boards are billed a monthly subscription fee by MemberGig through Stripe, in accordance with MemberGig’s current Pricing and Billing Policies.

 

3.4 Interactions With Sellers and Visitors
Communicate professionally and respectfully with Sellers and Visitors. Harassment, abusive behavior, or misleading communication may result in board suspension or account termination.

 

3.5 Compliance and Legal Responsibilities
Ensure your board and all posted content comply with applicable laws, including consumer protection, intellectual property, and privacy regulations.

MemberGig may suspend or terminate your account or board if content or actions violate these Terms, applicable laws, or platform guidelines.

 

3.6 Termination of Boards
MemberGig reserves the right to suspend or terminate your boards or account at its discretion. Upon termination, you will lose access to your boards, content, and any pending or future transactions. MemberGig is not liable for any loss of data or earnings.

 

3.7 Board Owner Disclaimer
Board Owners operate their boards independently. MemberGig does not review or endorse Board Owner rules, Content, pricing, or communication practices. Sellers and Visitors interact with Board Owners at their own risk. MemberGig is not responsible for any disputes or outcomes arising from board-specific decisions.

 

3.8 No Employment or Agency Relationship
Board Owners, Sellers, and Visitors use MemberGig as independent users. Nothing in these Terms creates an employment relationship, partnership, joint venture, or agency relationship between you and MemberGig. You do not have authority to act on behalf of MemberGig, and MemberGig is not responsible for your actions, representations, or obligations.

 

4. Seller Responsibilities

 

4.1 Account and Profile


Sellers are responsible for creating and maintaining accurate and up-to-date account information. This includes your name, email, and any details provided when posting on boards.

Provide truthful information about the content, such as goods and services, that you post. Misrepresentation may result in removal of posts or account suspension.

 

4.2 Posting and Content


Posts must comply with any board-specific rules and MemberGig guidelines. Post content that is illegal, offensive, or infringes on the rights of others may be removed by MemberGig or the Board Owner.

 

4.3 Interactions with Others


Communicate professionally and respectfully with Board Owners, other Sellers, and Visitors. Harassment, abusive behavior, or misleading communication may result in removal of posts or account suspension. Any messages sent through MemberGig’s chat feature must be lawful, respectful, and related to posted Content.

 

4.4 Board Access


Sellers may only post on boards where they have been approved by the Board Owner. Access to private boards requires approval from the Board Owner and must follow any rules or guidelines they establish.

 

4.5 Prohibited Conduct


Sellers may not:

  • Engage in illegal or harmful activities, including fraud or harassment.
  • Post content that infringes on intellectual property rights.
  • Spam or send unsolicited messages to Board Owners or Members.
  • Misrepresent themselves or their intentions.

 

4.6 Transactions with Board Owners


Refunds, cancellations, or disputes are the responsibility of the Board Owner and must be handled through their Stripe account. MemberGig is not involved in processing payments or resolving transaction issues between Sellers and Board Owners.

 

4.7 Compliance with Laws


Sellers are responsible for ensuring that their posts, services, and interactions comply with all applicable laws, including consumer protection, intellectual property, and privacy regulations.

 

4.8 Account Termination


MemberGig may suspend or terminate your Seller account, or your access to the platform entirely, if you violate platform rules, board guidelines, or applicable laws. If terminated, you will lose access to your posts, board participation, any private boards, and any other roles you hold on the platform. MemberGig is not liable for any loss of data, content, or earnings.

 

5. Visitor Responsibilities

 

5.1 Platform Access and Use


Visitors may browse and view content on public boards freely. Registration is required to contact Sellers. For private boards, you must request access from the Board Owner and wait for approval before viewing or interacting with any content or Seller. You agree to:

  • Compliance with Rules: Follow all MemberGig and board-specific guidelines.
  • Accurate Information: Provide truthful and up-to-date information when creating an account.
  • Usage Limitations: Use MemberGig only for personal or legitimate purposes related to viewing content.

 

5.2 Interactions


When engaging with Board Owners or Sellers:

  • Respectful Communication: Communicate professionally and respectfully.
  • Accurate Representation: Do not misrepresent your identity or intentions.
  • Legitimate Contact: Contact others only for purposes related to board content or inquiries about posted content.
  • Messages: Messages sent through the chat feature must be respectful, lawful, and directly related to a Seller’s posted Content.

 

5.3 Board Access


Visitors may access public boards without registering. Registration is required to interact with Sellers or request access to private boards.

 

5.4 Prohibited Conduct


Visitors may not:

  • Engage in illegal or harmful activities, including fraud or harassment.
  • Post, repost, or share content that infringes on intellectual property rights.
  • Spam, send unsolicited communications, or impersonate others.

 

5.5 Account Security


Visitors must maintain the confidentiality and security of your account information. Notify MemberGig immediately at support@MemberGig.com of unauthorized or suspicious activity

 

5.6 Compliance with Laws


Visitors are responsible for ensuring their actions comply with all applicable laws, including privacy, consumer protection, and intellectual property regulations.

 

5.7 Account Termination


MemberGig may suspend or terminate User accounts for violations of rules, illegal activity, or breaches of these Terms. You will lose access to your account and any saved content. MemberGig is not liable for any loss of data or earnings resulting from termination.

 

6. Payment & Transactions

MemberGig is not a party to transactions between Board Owners and Sellers and does not act as the seller, buyer, broker, or merchant of record for any transaction conducted on the platform.

Stripe is the third-party payment processor that manages all payment transactions on MemberGig. By using monetized boards, paying subscription fees, or receiving payouts, you agree to comply with Stripe’s terms and verification requirements which can be found on their site: https://stripe.com/legal/ssa. MemberGig is not responsible for delays, errors, account holds, chargebacks, or any actions taken by Stripe.

 

6.1 Board Owner Payments


Board Owners are responsible for all financial aspects of their boards, whether monetized or non-monetized.

  • Valid Payment Information: You must maintain accurate and current payment details in your MemberGig account. MemberGig is not responsible for issues caused by outdated or incorrect information.
  • Transaction Fees:
    • Monetized Boards: MemberGig automatically deducts a 15% platform fee per transaction. Stripe’s payment processing fees are also deducted.
    • Non-Monetized Boards: Board Owners pay a monthly subscription fee to allow Sellers to post for free. Subscription fees are non-refundable.
  • Currency and Processing: Payments are processed in your account’s currency through Stripe. Any currency conversion or international transaction fees are your responsibility.
  • Fund Transfers: Stripe transfers funds to your linked account after fees are deducted. You are responsible for ensuring your payment information is accurate so that payouts can be received.
  • Taxes: You are responsible for determining, collecting, reporting, and remitting any applicable taxes (including sales tax or VAT). MemberGig does not collect or remit taxes on your behalf.

 

6.2 Seller Payments


Sellers are responsible for maintaining valid payment information and paying the fees set by Board Owners.

  • Monetized Boards: Sellers pay the subscription or posting fees set by the Board Owner. Payments are processed automatically through Stripe until canceled. Fees already paid for the current billing period are non-refundable. Refunds, disputes, and chargebacks must be handled directly with the Board Owner. Board Owners may update pricing, and Sellers will be notified of changes.
  • Non-Monetized Boards: Sellers may post for free. The Board Owner pays the platform subscription fee for the board.

 

6.3 Subscription Payments

  • Recurring Charges: Sellers agree to recurring subscription fees as set by Board Owners. Payments continue automatically until canceled.
  • Cancellation: Sellers may cancel a board subscription at any time through their account. Fees already paid for the current billing period are non-refundable, and access continues until the end of that billing cycle. Additional posts purchased for that board are tied to the subscription and will be canceled if the subscription ends. Subscriptions to other boards are unaffected.
  • Price Changes: Board Owners may adjust subscription prices. Sellers will be notified of any pricing changes and may continue or cancel their subscription accordingly.

 

6.4 Refunds, Disputes, and Chargebacks


Board Owners are solely responsible for managing all refunds, cancellations, disputes, and chargebacks with Sellers. MemberGig is not a party to these transactions.

MemberGig may intervene only in cases involving suspected fraud or violations of MemberGig policies.

 

6.5 Payment Processor Fees


Stripe is a third-party payment processor that handles payments on MemberGig.

  • Any processor fees, including transaction, currency conversion, or cross-border fees, are your responsibility.
  • Users must comply with all processor terms and provide required verification information.

 

6.6 Fraud Prevention and Security


MemberGig prioritizes secure transactions.

  • Accounts involved in fraudulent activity, policy violations, or disputed payments may be suspended or terminated.
  • MemberGig may investigate suspected fraud or illegal activity and take any appropriate action, including restricting accounts or reporting violations to authorities.
  • MemberGig is not responsible for losses resulting from unauthorized transactions or actions taken to prevent fraud.

 

6.7 No Guarantee of Earnings


MemberGig does not guarantee any level of earnings, income, sales, or business success. Any revenue earned through the platform depends on factors outside of MemberGig’s control, including pricing, demand, content quality, and user activity.

 

7. User Content

 

7.1 Ownership of Your Content


You retain ownership of any content you create, post, or upload to MemberGig, including text, images, videos, audio, and other materials (“Content”).

 

7.2 License to MemberGig
By posting Content on MemberGig, you grant the platform a non-exclusive, worldwide, royalty-free license to host, display, distribute, and use your Content for the purpose of operating and promoting the platform. This license remains in effect while your Content is available on the platform and ends when the Content is removed, except where copies remain in backups or where the Content has been publicly shared.

 

7.3 License to Board Owners
Sellers who post Content on a board grant the applicable Board Owner a non-exclusive, royalty-free license to display and use that Content on the associated board. This license ends when the Content is removed from the board.

 

7.4 Responsibility for Content
You are solely responsible for your Content. Content must be accurate, lawful, and must not infringe upon any third-party rights, including intellectual property, privacy, or publicity rights. Content that is illegal, harmful, infringing, or that violates platform policies or board-specific rules may be removed.

 

7.5 Modification of Content
MemberGig may resize images, adjust formatting, or make technical modifications to Content as reasonably necessary to ensure proper functionality and display of the platform.

 

7.6 Promotional Use
MemberGig may display your Content as necessary to operate the platform, including showing posts on public boards that Visitors may browse. MemberGig may also use your Content for marketing or promotional purposes related to the platform. You may request to opt out of promotional use by contacting MemberGig; however, such requests are subject to reasonable limitations, and the license required to operate and display the platform will remain in effect.

 

7.7 Content Removal and Retention
You may remove your Content at any time. Once removed, MemberGig will stop displaying the Content, but copies may remain in system backups or may have been saved or shared by third parties. MemberGig is not responsible for any third-party retention, copying, or distribution of removed Content.

 

7.8 Reporting Content Violations
If you encounter Content that you believe violates these Terms, you may report it to the applicable Board Owner or to MemberGig. MemberGig may review and remove Content or take other appropriate action at its discretion.

 

8. Intellectual Property

 

8.1 Platform Ownership
MemberGig owns all rights, title, and interest in and to the platform, including its software, design, user interface, branding, trademarks, and proprietary tools. These elements may not be copied, modified, distributed, or used without MemberGig’s prior written permission.

 

8.2 Limited License to Users
MemberGig grants you a limited, non-transferable, non-exclusive, and revocable license to access and use the platform solely for its intended purposes and in accordance with these Terms. You may not copy, reproduce, reverse engineer, modify, distribute, or otherwise exploit any part of the platform.

 

8.3 Third-Party Content and Links
MemberGig may display third-party content or provide links to external websites or services. MemberGig does not control, review, or endorse any third-party content, products, or services. Integrated or linked third-party services, including payment processors such as Stripe, are governed by their own terms and policies. Your access to and use of third-party content or services is at your own risk, and MemberGig is not responsible for any issues, losses, or damages arising from such access or use.

 

9. Copyright and DMCA Policy

 

9.1 Copyright Protection
MemberGig respects intellectual property rights and complies with the Digital Millennium Copyright Act (“DMCA”).

 

9.2 Submitting a Takedown Notice
If you believe your copyrighted work has been used on MemberGig without authorization, you may submit a DMCA takedown notice to support@membergig.com. Your notice must include your name and contact information, identification of the copyrighted work you claim has been infringed, identification of the allegedly infringing Content and where it appears on the platform, a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law, and a statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

 

9.3 Counter-Notices
If your Content was removed in error or misidentification, you may submit a counter-notice. MemberGig will review the counter-notice and may reinstate the Content in accordance with applicable DMCA procedures.

 

9.4 Repeat Infringers
MemberGig may suspend or terminate accounts of users who repeatedly infringe intellectual property rights.

 

10. Platform Usage & Restrictions

 

10.1 Acceptable Use
You agree to use MemberGig only for lawful and intended purposes, including creating boards, posting Content, and interacting with other users. You must comply with applicable laws, follow platform guidelines, and communicate respectfully and professionally.

 

10.2 Prohibited Uses
You may not use MemberGig to engage in illegal activity, fraud, or the sale of prohibited items; harass, threaten, or abuse other users or MemberGig staff; post harmful, offensive, defamatory, or discriminatory Content; impersonate others or provide false or misleading information; spam, send unsolicited communications, or manipulate platform functionality; infringe upon the intellectual property rights of others; or access or use the platform in a manner that disrupts or interferes with normal operations.

 

10.3 Security and System Restrictions
You may not upload malware, viruses, or harmful software; attempt to gain unauthorized access to accounts, systems, or sensitive data; use automated tools, bots, or scraping technologies without permission; or exploit bugs or vulnerabilities to obtain unauthorized access or disrupt the platform.

 

10.4 Suspension or Termination
MemberGig may suspend or terminate your account for prohibited activity or violations of these Terms. Termination may result in the loss of access to the platform, including Content, communications, and ongoing activity. You may contact MemberGig to request a review; however, MemberGig’s determination will be final.

 

10.5 Platform Rights
MemberGig may modify, update, or discontinue platform features without liability; remove Content that violates these Terms, community guidelines, or applicable laws; and monitor platform activity as reasonably necessary to ensure compliance.

 

10.6 Feedback and Suggestions
Any ideas, feedback, or suggestions you provide may be used by MemberGig to improve the platform. MemberGig has no obligation to provide compensation for such submissions.

 

10.7 Service Availability
MemberGig strives to provide reliable access to the platform but does not guarantee uninterrupted service. Service interruptions may occur due to maintenance, technical issues, or factors outside of MemberGig’s control. MemberGig is not liable for losses resulting from downtime or access limitations.

 

11. Privacy & Data

By using MemberGig, you agree to the collection, use, and storage of your personal information as described in our Privacy Policy, which is incorporated into these Terms by reference. MemberGig is not responsible for the data practices of third-party services integrated with the platform, including payment processors, email providers, or hosting services. Your continued use of MemberGig after updates to the Privacy Policy constitutes acceptance of the revised policy.

 

12. Dispute Resolution & Governing Law

 

12.1 Informal Resolution and Arbitration
If a dispute arises, you agree to first attempt to resolve it informally by contacting MemberGig at support@membergig.com. If the dispute cannot be resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms or your use of MemberGig will be resolved exclusively through binding arbitration rather than in court. By using MemberGig, you agree to participate in this arbitration process. Arbitration will take place in Atlanta, Georgia, and will be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA) or another mutually agreed arbitration organization. Arbitration will be conducted on an individual basis only, and class actions, collective actions, and representative actions are not permitted.

Each party is responsible for its own costs and expenses, unless the arbitrator awards attorney’s fees or costs under applicable law. The arbitrator’s decision is final and binding, and a court of competent jurisdiction may enter judgment solely to enforce the arbitration award. You waive any right to a jury trial.

Any claim arising out of or relating to these Terms must be filed within one (1) year of the event giving rise to the claim, or it will be permanently barred.

 

12.2 Governing Law and Contact Information
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Dispute-related inquiries may be sent by email to support@membergig.com or by mail to PO Box 18532, Atlanta, GA 31126.

 

13. Indemnity & Liability

 

13.1 Indemnity
You agree to indemnify, defend, and hold harmless MemberGig and its officers, directors, employees, agents, and affiliates from and against any claims, losses, liabilities, damages, costs, or expenses, including reasonable attorney’s fees, arising out of your use of MemberGig, your violation of these Terms or applicable laws, your infringement of third-party rights, any Content you post, upload, or share, or your interactions with Board Owners, Sellers, or Visitors. This obligation survives termination of your account or use of the platform.

 

13.2 Board Owner Responsibility
Board Owners are solely responsible for the content, communications, and transactions that occur on their boards. MemberGig does not review, verify, or guarantee the accuracy, legality, or quality of Board Owner content or interactions. Any disputes or issues arising from Board Owner activity are the sole responsibility of the involved parties.

 

13.3 Limitation of Liability
To the fullest extent permitted by law, MemberGig is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, data, or business opportunities, or for your inability to access or use the platform. If you bring a claim against MemberGig, our total liability will not exceed the greater of the amount you paid to MemberGig in the twelve (12) months preceding the claim or one hundred dollars ($100). These limitations apply regardless of the legal theory asserted, whether contract, tort, negligence, strict liability, or otherwise, even if MemberGig was advised of the possibility of such damages.

 

13.4 No Guarantee of Service
MemberGig is provided on an “as-is” and “as-available” basis. We do not guarantee uninterrupted access, error-free operation, or secure performance. Service interruptions, delays, or data loss may occur.

 

13.5 Force Majeure
MemberGig is not responsible for any failure or delay resulting from events beyond its reasonable control, including natural disasters, acts of war or terrorism, labor disputes, technical failures, or government actions.

 

13.6 Jurisdictional Limitations
Some jurisdictions do not allow certain warranty disclaimers or liability limitations. In those jurisdictions, MemberGig’s liability will be limited to the maximum extent permitted by applicable law.

 

13.7 Integrated Third-Party Services
MemberGig may integrate with third-party services such as payment processors, hosting providers, and email delivery services. These third-party services operate under their own terms and policies. MemberGig is not responsible for outages, errors, delays, data practices, account holds, or actions taken by these third-party providers.

 

14. Termination & Suspension

 

14.1 Platform Suspension or Termination
MemberGig may suspend or terminate your account, board, Seller account, or individual posts at any time for violations of these Terms or for conduct deemed inappropriate or harmful to the platform. Suspension or termination may result in the loss of access to Content, transactions, communications, and platform features.

 

14.2 Board Owner Enforcement
Board Owners may suspend or remove posts or Sellers from their boards for violations of board-specific rules or policies. Enforcement actions taken by Board Owners or by MemberGig are final.

 

14.3 User-Initiated Termination
You may terminate your account at any time. Termination revokes access to your account and associated Content; however, any obligations incurred prior to termination will remain in effect.

 

14.4 Pending Transactions
Pending or in-progress transactions will be handled in accordance with platform policies. MemberGig and Board Owners are not responsible for delays, interruptions, or losses resulting from suspended or terminated accounts.

 

14.5 Integrated Services
Termination of your MemberGig account does not affect your relationship with any integrated third-party services, including payment processors such as Stripe. Such relationships are governed by separate agreements and terms.

 

14.6 Survival of Obligations
Provisions relating to indemnification, limitation of liability, dispute resolution, and any other sections that by their nature should survive termination will continue to apply after your account is terminated.

 

14.7 Finality of Decisions
MemberGig’s decisions regarding suspension or termination are final. Any disputes related to such decisions must be resolved exclusively through arbitration as described in Section 12.

 

14.8 One-Year Limit on Termination Claims
Any claim arising out of or relating to the suspension or termination of your account must be filed within one (1) year of the event giving rise to the claim, or the claim will be permanently barred.

 

15. Changes to Terms

 

15.1 Right to Modify
MemberGig may update these Terms from time to time. Any changes will be posted with an updated “Last Revised” date.

 

15.2 Notice and Acceptance
Important changes may be shared through the platform or by email. By continuing to use MemberGig after changes are posted, you agree to the updated Terms. If you do not agree, you must stop using the platform.

 

15.3 No Waiver and Severability
If MemberGig does not enforce a part of these Terms, it does not mean that right is waived. If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will still apply.
